DEAL DROP LLC TERMS AND CONDITIONS

1. GENERAL TERMS

By using www.lubbockdealdrop.com (the "Site"), you agree to these legally binding terms. Deal Drop LLC ("Company," "we," "us") reserves the right to amend these terms at any time.

2. USER RESPONSIBILITIES

  • Account Security: You are responsible for all activity under your account.

  • Bidding: All bids are binding. Winning bidders must pay within 3 business days of auction close.

  • Prohibited Conduct:

    • No false bids, fraud, or interference with auctions.

    • No commercial use of our Site or buyer data (e.g., scraping, reselling access).

3. PAYMENT & PICKUP

  • Payment: Due within 3 business days via approved methods (credit/debit, PayPal). Late payments may incur a restocking fee and account suspension.

  • Pickup:

    • Injury Disclaimer: Buyers assume all risks during pickup. Company is not liable for injuries, accidents, or property damage on-site or during transport.

    • Late Pickup Fee: 10% of purchase price after deadline.

    • Abandoned Items: Unclaimed items after 7 days will be resold; no refunds.

4. ITEMS & CONDITION

  • "AS IS" Sales: All items sold without warranties (express or implied). Descriptions are for guidance only.

  • Inspection: Buyers must inspect items before leaving pickup location. No claims accepted afterward.

  • Heavy/High-Risk Items: Buyers are solely responsible for safe loading/securing of items (e.g., furniture, machinery). We recommend professional movers.

5. LIABILITY LIMITATIONS

  • No Liability For:

    • Injuries/deaths during pickup.

    • Lost/stolen items after pickup begins.

    • Errors in listings (e.g., typos, incorrect photos).

    • Buyer’s resale of items (e.g., regulatory compliance, recalls).

  • Indemnification: You agree to cover all legal costs if your actions (e.g., misuse of Site, injury claims) result in claims against us.

6. DISPUTES & LEGAL

  • Texas Law: Governed by Texas law; disputes resolved in Lubbock County courts.

  • Class Action Waiver: Claims must be filed individually—no class actions.

  • Force Majeure: Not liable for delays/cancellations due to emergencies (e.g., fires, floods).

7. MISCELLANEOUS

  • Photography Release: We may photograph/video auctions; entry constitutes consent.

  • Right to Refuse Service: We may ban users for violations at our discretion.
